This English text is a courtesy translation. The privacy notice that has legal effect is the Spanish version, published at www.bimcogd.com/aviso-de-privacidad/, in accordance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties.

BIMCO GERENCIA DIGITAL, S.A. DE C.V. (hereinafter “BIMCO” or the “Controller”), with address at Av. Manuel Acuña 3497, Col. Rinconada Santa Rita, C.P. 44690, Guadalajara, Jalisco; and website www.bimcogd.com, is responsible for the use and protection of your personal data whenever the data subject provides us with such data by any means of communication, whether in person or through electronic means. In this regard, we inform you of the following:

In accordance with the provisions of the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (the “law”), the following Privacy Notice is made available to the users of its website. Its purpose is to inform the data subject about the treatment given to their personal data when such data is collected, used, stored and/or transferred by the Controller.

What will we use your personal data for?

The personal data we collect from you will be used for the following purposes, which are necessary for the service you request:

  • Handling information and contact requests: To respond to the requests, questions and comments you send us through the contact form on our website, by email, by phone or via WhatsApp.
  • Preparing proposals and quotes: To analyze the scope of the project, define its BIM USE, the level of development (LOD) and level of information (LOI), and prepare the corresponding technical and commercial proposal.
  • Providing the contracted services: To carry out the design, laser scanning survey, modeling, discipline coordination, metal cladding and any other BIM services requested, as well as to hand over their results.
  • Project follow-up and communication: To coordinate meetings, address reviews and comments, and keep the client informed about the progress and deliverables of their project.
  • Invoicing, payments and collections: To issue tax receipts, manage and validate payments, carry out collection management and provide the corresponding proof of payment.
  • Compliance with legal and contractual obligations: To comply with tax and accounting regulations and with the obligations arising from our contractual relationship with clients, suppliers and collaborators.
  • Identity verification: To confirm the identity of the data subject or the authority of whoever represents them, and to prevent identity theft.
  • Client file management: To build and keep up to date the commercial, contractual and billing file associated with each project.
  • Fraud prevention and information security: To detect suspicious activity, safeguard the technical documentation of the project and protect the data of the data subjects.
  • Service optimization: To gather opinions and suggestions that allow us to improve our processes, our deliverables and our client service.

In addition, we will use your personal information for the following secondary purposes, which allow us to provide you with better care and service:

  • Commercial prospecting and marketing: To send you information about our services, newsletters, event invitations and any relevant content from the industry.
  • Case study publication: To mention the project and, where applicable, show images or models of it on our website, presentations and social media, always subject to the data subject’s authorization.
  • Statistics and website improvement: To carry out market research, satisfaction surveys and statistical analysis that allow us to improve the website and our clients’ experience.

If you do not wish your personal data to be processed for these secondary purposes, you must send an email to contacto@bimcogd.com stating that you do not want your personal data to be processed for the secondary purposes described above.

Refusing the use of your personal data for these secondary purposes may not be a reason for us to deny you the services you request or contract from BIMCO.

The data subject who submits and provides the information is solely responsible for the truthfulness and accuracy of the data included, releasing BIMCO from any liability in this respect. The data subject warrants and is liable, in any case, for the accuracy, validity and authenticity of the information provided, and undertakes to keep it duly updated.

Please be advised that personal databases will be created for any legitimate purpose consistent with the activities and aims pursued, and that your consent will be requested should we need to use your data for purposes other than those set out in this Privacy Notice.

What personal data will we use for these purposes?

In order to carry out the purposes described in this privacy notice, we will use the following personal data:

  • Personal identification and contact data such as: full name, email address, trade name or company name, position within the company, phone number and postal address.
  • Billing data such as: Federal Taxpayer Registry (RFC) or Tax Identification Number, name or corporate name, line of business, tax domicile or postal code, tax regime and intended use of the tax receipt.
  • Technical project information that the data subject shares with us through the contact form or by any other means, such as: drawings, surveys, photographs, models, material lists, technical specifications and the location of the construction site. This information is treated as part of the corresponding request or project and solely for the primary purposes set out in this Privacy Notice.
  • Browsing data on the website, under the terms described in the section on tracking technologies.

BIMCO does not request or collect sensitive personal data, nor financial or asset data, through its website: the site does not process online payments. Should any such data be required for a specific purpose, the data subject’s express consent will be requested beforehand, under the terms required by law.

Your personal data may be shared with parent companies, affiliates, subsidiaries or any entity within the same corporate group — BIMCO is part of Grupo Cotekno — or with authorized third parties, so that the same internal procedures and policies are followed. This is done in order to centralize information, document and formalize operational and/or corporate restructuring, as well as for statistical purposes and historical client records.

Likewise, it may be shared with government authorities, competent bodies or entities, in order to verify information, comply with legal obligations and/or respond to requests from the relevant authorities, where applicable; with accounting, tax and legal advisors; with collection agencies, to carry out judicial or extrajudicial collection of unpaid services; and, finally, with unaffiliated third parties acting as data processors on behalf of the Controller — such as our website hosting, contact form management and email providers, which may be located outside Mexico — solely to support the provision of the services we offer, without this entailing any purpose other than those set out herein.

How can you access, rectify or cancel your personal data, or object to its use?

Exercising ARCO rights.

As the subject of the data provided to the Controller, you have the right to know what personal data we hold about you, what we use it for and the conditions of such use (Access). You are likewise entitled to request the correction of your personal information if it is outdated, inaccurate or incomplete (Rectification); to request that the information be removed from our records or databases when you consider that it is not being used appropriately (Cancellation); as well as to object to the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

Request to exercise ARCO rights.

To exercise any of the ARCO rights, you must submit the corresponding request by sending an email to contacto@bimcogd.com.

With regard to the procedure and requirements for exercising your ARCO rights, we inform you of the following:

a) What information and/or documentation must the request contain?

  1. The full name and email address of the data subject;
  2. The documents proving the identity or, where applicable, the legal representation of the data subject;
  3. A clear and precise description of the personal data in respect of which any of the ARCO rights is to be exercised;
  4. The modifications to be made, together with the documentation supporting the request.

b) Within how many days will we respond to your request?

Within a maximum period of twenty business days, counted from the date on which the request for access, rectification, cancellation or opposition was fully received.

c) By which means will we communicate our response to your request?

By email, through the address contacto@bimcogd.com.

For further information about the procedure, we make the email address mentioned above available to you. The BIMCO team is in charge of receiving and processing ARCO rights requests.

You may withdraw your consent to the use of your personal data.

You may withdraw the consent you may have given us for the processing of your personal data. However, please bear in mind that we will not be able to answer your request or discontinue the use immediately in every case, since we may be required by a legal obligation to continue processing your personal data. You should also consider that, for certain purposes, withdrawing your consent will mean that we can no longer provide the service you requested, or that our relationship with you comes to an end.

To withdraw your consent, you must submit your request following the same procedure and requirements as a request to exercise ARCO rights.

The use of tracking technologies on our website.

Our website uses advertising and measurement cookies associated with Google Ads (the Google tag, gtag.js). These cookies let us know whether your visit came from one of our ads, measure the effectiveness of our campaigns and, where applicable, show you our services again in ads on other websites (remarketing). We do not use these technologies to build profiles for the purpose of selling or transferring your data to third parties. Our website also embeds other third-party services — the Google Maps map and the Google Fonts typefaces — which, when loaded, may set cookies or record technical data about your browsing in accordance with their own privacy policies.

Please note that our website may use cookies, web beacons or other tracking technologies through which it is possible to monitor your behavior as an internet user, as well as to provide you with a better service and experience while browsing our site. Any personal data collected through these technologies will be used for purely statistical purposes and for the ongoing improvement of our website, and would be the following:

  • (i) User behavior regarding the sections visited within our website, as well as the time spent in each section;
  • (ii) The user’s preferred language, and
  • (iii) The region where the user is located.

These technologies cannot be disabled unless you adjust the permissions and authorizations of your search engine or web browser. If you do not wish your personal data to be processed in this way, you must leave our website immediately.

Amendments to the Privacy Notice

This Privacy Notice may be changed or amended at any time by the Controller in order to address legislative or case-law reforms, internal policies, as well as new requirements for the provision of our services. Should this occur, we will inform you through announcements, communications or notifications sent to the email address provided, or through the Controller’s website, which is www.bimcogd.com, where you may consult the updates to this Privacy Notice.

Should BIMCO not receive your express objection to your personal data being used and/or transferred in the manner and terms described above, it will be understood that the data subject has tacitly granted their consent to the Controller, to the extent permitted by applicable law.
